You understand and agree that the Service is provided “AS-IS” and that Lady Jessica assumes no responsibility for the timeliness, deletion, mis-delivery or failure on your part to store any downloads.   1. PAYMENT: Payments for your use of the Service will be automatically billed to the person/account you provide in your Billing Data. Charges billed one time only for for your immediate purchase(s).
  1. PRIVACY POLICY: All of your information is kept confidential. No personal information (dob, credit card information, etc) will be retained. Emails will only be saved for communication purposes as outlined above.
  1. 6.9 interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

6.10 intentionally or unintentionally violate any applicable local, state, national or international law.

6.11 collect or store personal data about other users. You acknowledge that Lady Jessica shall have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service. Without limiting the foregoing, Lady Jessica has the right to remove any Content that violates the TOS or is otherwise objectionable.   1. REFUNDS/TERMINATION: You agree that Lady Jessica may, under certain circumstances and without prior notice, immediately terminate your access to the Service. All fees paid to Lady Jessica are non-refundable.

PROPRIETARY RIGHTS: You acknowledge and agree that the Service and any necessary software used in connection with the Service (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You agree not to access the Service by any means other than through the interface that is provided by Lady Jessica’s Hypnotic Files for use in accessing the Service.

The free digital media files MAY be downloaded, copied or shared but MAY NOT be sold. The purchased digital audio content MAY NOT be copied, shared or sold. You acknowledge that Lady Jessica owns all right, title and interest, including without limitation all Intellectual Property Rights, in and to the Products, and that You WILL NOT acquire any right, title, or interest in or to the Products except as expressly set forth under these conditions. You WILL NOT modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive original media from any of Lady Jessica’s products, or create or attempt to create a substitute or similar product through use of the Product or proprietary information related thereto. You WILL NOT remove, obscure, or alter Lady Jessica’s copyright notice, Brand Features, or other proprietary rights notices affixed to or contained within any of Lady Jessica’s products.

DOWNLOAD FOR PERSONAL USE – The audio files are intended for use with individuals. This is a single entity, exclusive, non-transferable license, meaning You, the sole purchaser, are the exclusive owner of this license and may transfer the Digital Media Files between personal computers, iPods, and other media viewing sources for personal use, but public or large scale viewing (of 3 people or more) is strictly forbidden. You MAY NOT post the files on your website or other Internet websites (Youtube, Facebook, MySpace, etc.). Lady Jessica’s files MAY NOT be incorporated into a derivative work such as video(s), multimedia work, advertisement, live performance, Internet website, presentation or print project. The files MAY NOT be used for other audios, stage shows, feature films/videos, documentaries, direct to video, or broadcast. Lady Jessica’s Media Files MAY NOT be sold.

This Agreement shall be effective as of the earliest of the date you download, install or use, the file(s) and shall continue in effect for the entire copyright period.. This Agreement is non transferable and is only granted to you.

Warranty & Return Policy: Lady Jessica warrants the Media Files to be free from defects in material and workmanship.
As these are immediately downloadable, all sales are final. Refunds are not available for immediately downloadable products. Refunds are not given for free products for any reason. Please listen responsibly.
